It's time to rally our community and continue our work to preserve and protect Shollenberger Park from the pollution of the proposed Dutra Asphalt factory. So many residents have moved to Petaluma during the Pandemic years - new families, young adults, retirees. Speaking to new parents at McNear Park babysitting my granddaughter, I discovered that many new residents know nothing about this threat to the healthy environment and open space that brought them to choose Petaluma. It's news to them that a noxious<span class="Apple-converted-space"> </span>and toxic Asphalt Factory has been approved by the Board of Supervisors at the gateway to our CIty and County. We have been fighting to stop this project since 2007, 16 years - we’re a community that will not quit.</p><p class="p2" style="background-color: white; color: #1a1a1a; font-family: Arial; font-feature-settings: normal; font-kerning: auto; font-optical-sizing: auto; font-size: 13px; font-stretch: normal; font-variant-alternates: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-variation-settings: normal; line-height: normal; margin: 0px; min-height: 15px;"><br /></p><p class="p1" style="background-color: white; color: #1a1a1a; font-family: Arial; font-feature-settings: normal; font-kerning: auto; font-optical-sizing: auto; font-size: 13px; font-stretch: normal; font-variant-alternates: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-variation-settings: normal; line-height: normal; margin: 0px;">McNear Park and neighborhood, hundreds of Quarry Heights subdivision homes and McNear Landing homes are in close proximity to the Dutra factory site. Kaiser Medical center and many corporate headquarters are situated east of Shollenberger and will be directly impacted. Prevailing winds blow SE from the Dutra site over the park, towards the Adobe Creek Subdivision and Keller Estates vineyards. An air quality scientist pointed out to me looking across the river to Quarry Heights homes as we were walking the Shollenberger path: “I’ve never seen a wind that didn’t change direction. These homeowners should be concerned.” By-products of asphalt manufacture include toxic heavy metals that are not filtered and are not soluble. They will be carried by the wind and accumulate in the soil. 250 diesel trucks emitting noxious exhaust are permitted by the FEIR to arrive at the site daily. Blue Smoke (PAHs) will rise from trucks loaded with hot asphalt and is carcinogenic. Work can go on 24/7 for state and municipal projects with all night truck traffic, noise, and industrial lighting.</p><p class="p2" style="background-color: white; color: #1a1a1a; font-family: Arial; font-feature-settings: normal; font-kerning: auto; font-optical-sizing: auto; font-size: 13px; font-stretch: normal; font-variant-alternates: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-variation-settings: normal; line-height: normal; margin: 0px; min-height: 15px;"><br /></p><p class="p1" style="background-color: white; color: #1a1a1a; font-family: Arial; font-feature-settings: normal; font-kerning: auto; font-optical-sizing: auto; font-size: 13px; font-stretch: normal; font-variant-alternates: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-variation-settings: normal; line-height: normal; margin: 0px;">The FEIR (Final Environmental Impact Report) was certified in 2010 by a close 3-2 vote of the Supervisors. Thousands of residents opposed the factory approval, wrote letters, spoke at hearings, raised and donated money to litigate the decision. The City of Petaluma joined us in the lawsuit. Our City Council was unanimous in opposing this County approved project so close to our city limits. Although we lost in Superior court and also lost our appeal, we learned a valuable lesson. Courts do not like to undo what the Elected have approved. It is imperative to elect Supervisors who understand the value of clean air, open space, and wetlands. The current sitting Supervisors may be more tuned in to what is at stake if this asphalt factory is built. With asphalt factory fires among leading industrial fire sites nationwide, Dutra poses a clear and present danger for fire and toxic smoke to Petaluma.</p><p class="p2" style="background-color: white; color: #1a1a1a; font-family: Arial; font-feature-settings: normal; font-kerning: auto; font-optical-sizing: auto; font-size: 13px; font-stretch: normal; font-variant-alternates: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-variation-settings: normal; line-height: normal; margin: 0px; min-height: 15px;"><br /></p><p class="p1" style="background-color: white; color: #1a1a1a; font-family: Arial; font-feature-settings: normal; font-kerning: auto; font-optical-sizing: auto; font-size: 13px; font-stretch: normal; font-variant-alternates: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-variation-settings: normal; line-height: normal; margin: 0px;">Dutra has a "new plan" that excludes the original wetland restoration proposed and required in the original plan. Dutra now maintains that the project has no protected wetlands so does not need a Wetlands Permit (404 - Clean Water Act) as required by FEIR. Dutra wants this Condition of Approval (COA) removed because they can’t get their 404 permit from the Army Corps of Engineers (USACE) and The Regional Water Quality Control Board (RWQCB). The RWQCB rejected Dutra’s application because asphalt production is not “water dependent” and therefore does not need to be located on a sensitive river and wetlands to be economically viable. They told Dutra find an alternative site.</p><p class="p2" style="background-color: white; color: #1a1a1a; font-family: Arial; font-feature-settings: normal; font-kerning: auto; font-optical-sizing: auto; font-size: 13px; font-stretch: normal; font-variant-alternates: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-variation-settings: normal; line-height: normal; margin: 0px; min-height: 15px;"><br /></p><p class="p1" style="background-color: white; color: #1a1a1a; font-family: Arial; font-feature-settings: normal; font-kerning: auto; font-optical-sizing: auto; font-size: 13px; font-stretch: normal; font-variant-alternates: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-variation-settings: normal; line-height: normal; margin: 0px;">As you will read in the attached letter form Tennis Wicks, Director of Planning, only the Supervisors can amend a COA for this project. The request must go back to the Board of Supervisors (BOA). The “New Project” is indeed new - and different - and must go through the CEQA process. The public has a right to scrutinize and comment on the “new”</p><p class="p1" style="background-color: white; color: #1a1a1a; font-family: Arial; font-feature-settings: normal; font-kerning: auto; font-optical-sizing: auto; font-size: 13px; font-stretch: normal; font-variant-alternates: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-variation-settings: normal; line-height: normal; margin: 0px;">project. That’s where we come in - when this meeting is scheduled, we’ll be asking you to send emails and letters and to make phone calls in support of the Planning DIrector’s decision. <p></p>Now installed on the south path of Shollenberger Park<br />
<p></p>Over 40 citizens, companies, and non-profit organizations donated<br />
funds to install this commodious bench:<br />
<p></p>Camelbak, Alvarado Street Bakery, and Azure Town Homes have<br />
supported the community's efforts to preserve and protect<br />
Shollenberger Park from the beginning.<br />
<p></p>Heritage Salvage designed and built the bench of old-growth redwood<br />
and donated it to the community.<br />
<p></p>The bench commemorates the community’s efforts to challenge the Dutra<br />
asphalt factory proposal, and the lifetime commitment of Bill Kortum<br />
to preserve open space, which he called “The Commons”, an asset that<br />
belongs to us all.<br />
<p></p>All are invited to attend the dedication of the bench on site at<br />

Dutra told to justify the need for asphalt plant in Petaluma: State agency declares Dutra Haystack Asphalt Plant's Alternative Site Analysis "Invalid" <br />
<br />
Dutra is required to obtain a series of federal, state and agency permits and agreements prior to building and operating their proposed, controversial asphalt factory on 38 acres of land including wetlands and sensitive habitat the Petaluma River just outside Petaluma city limits, within Sonoma County jurisdiction. <br />
<br />
On Nov. 10, 2016, the SF Bay Regional Water Quality Control Board (RWQCB) sent the attached letter declaring that Dutra's required Alternatives Analysis for the federal Clean Water Act §401Water Quality Certification and compliance with the §404 Wetlands Permit application, is "invalid." <br />
<br />
Dutra failed to provide important evidence and data necessary for the RWQCB to analyze and legally confirm their Petaluma site as the "Least Environmentally Damaging Practicable Alternative."<br />
<br />
Importantly, the Regional Board notified Dutra that, given the existing permitted and operating capacity in the North Bay for meeting regional needs to supply RAP (reclaimed asphalt pavement), Dutra will have to establish that there is an unmet need for additional asphalt production. That will be a very steep climb for them, given that during the County's project approval process, County PRMD staff already established that there is a surplus of existing, permitted asphalt production capacity in the North Bay to meet current and future demands. <br />
<br />
"... the Alternatives Analysis will need to clearly demonstrate that the project is clearly needed to meet the market demand for RAP, and aggregate and sand products in the area. Otherwise, the No Project Alternative will meet the overall project objective and therefore be the least environmentally damaging practicable alternative." (emphasis added, RWQCB letter, page 2)<br />
<br />
In addition, the RWQCB also is requiring verifiable proof from Dutra:<br />
<br />
- that Hot Mix Asphalt or Warm Mix Asphalt cannot be delivered to the proposed service area from more distant alternative sites, given 2-3 hour transport times for hot asphalt;<br />
<br />
- that Dutra has permission to use Shamrock's e-crane (electric crane) for unloading barges of aggregate at Shamrock's adjacent dock, since none has ever been presented;<br />
<br />
- that Dutra can safely moor and unload barges without interfering with other river traffic and uses, and without intruding into the 100' wide federal navigable waterway;<br />
<br />
- that Dutra has not properly analyzed alternative sites' potential for rail or truck deliveries of aggregate and transport of asphalt products <br />
<br />
We are very pleased to see this independent evaluation and objection by the RWQCB. This affirms our longstanding evaluation that there is no necessity for a new asphalt plant here, no less at Shollenberger Park, the Petaluma River and the gateway entrance to Petaluma and Sonoma County. As we have stated clearly, asphalt production is NOT a water-dependent activity. Most all asphalt plants nationwide are nowhere near water access.<br />
<br />
Concerned community members, elected officials, and non-profit organizations have opposed the project for over 12 years. We have worked to inform the public and rally them to preserve and protect Shollenberger Park and the health of all Petalumans. <br />
<br />
According to environmental experts, the potential impacts of operating an asphalt factory so close to this sensitive ecosystem, public park and the Petaluma River make this site inappropriate. Over 150,000 visitors to Shollenberger Park per year enjoy and appreciate our most popular City park, and is a great draw for families, runners, school children, birders, eco-tourists and researchers. The Petaluma River has become one of the most popular locations around the SF Bay for rowers and paddlers. <br />

Contrary to what some may say, it is not over yet. There is a long permitting process facing Dutra before they can break ground – this will certainly not happen this summer as misreported in the Argus recently. In fact, the permitting process in various federal and regional agencies (State Water Resources Control Board, California and US Fish & Wildlife, U.S. Army Corps of Engineers, State Lands Commission, SMART rail and more) is complex and the public has a right to provide input. At this time, we are not aware of any changes from the situation as described by Ken Ellison on March 2, 2015:<br />

“Dutra has to meet all applicable conditions prior to any building permit issuance. They have not completed that task yet, and no building permits have been issued (or even applied for last time I checked).” Ken Ellison , Supervising Planner County of Sonoma County PRMD.<br />
<br />
Our attorneys and scientific experts are scrutinizing Dutra’s applications for the various permits as they are submitted and we are already challenging their accuracy and validity.<br />

With lively music by Larry Potts and Friends greeting the attendees to world class jazz with the Tracy Rose Quartet.The guests enjoyed Preferred Sonoma Caterers award winning vegetarian chile. Delicious cookies and generously donated Three Twins ice cream capped off what was a perfect evening under a full moon. Mayor David Glass welcomed everyone and talked about how Petaluma City Council joined Friends of Shollenberger coalition in working to prevent an asphalt plant from as the landmark and unwelcoming gateway to Petaluma and Sonoma County. Mayor Glass's speech was followed by David Keller who presented the group with an overview how Dutra Asphalt Company must meet stringent regulations before any asphalt can ever be produced on this pristine piece of property. Friends of Shollenberger is dedicated to ensure that ALL regulations and mandatory requirements are met. Dutra will not be allowed to side step environmental concerns and negative impacts on the Petaluma River or the community in general. Joan Cooper, coordinator of the Shollenberger Shindig 4 spoke briefly and thanked all of the volunteers and supporters. <br />

Lucy Kortum guest of honor, wife and lifetime activist partner to Bill Kortum, a great leader in saving our environment, and protecting the California Coast. "Never Give Up" a theme Bill often used will be engraved on the Friends of Shollenberger bench. <br />

Six years ago our community and City Council stood up for Shollenberger Park and rejected the Dutra asphalt factory proposal in favor of the health and quality of life in Petaluma. We spoke at the Board of Supervisors hearings, we wrote letters and emails, and thousands signed petitions. We spoke out against allowing a private business, Dutra Materials, to ruin our most popular park and valuable wetlands. We said "NO" to Dutra's asphalt factory towers and trucks blighting our Gateway and the banks of our River.<br />
<br />
Three of our our elected Supervisors (Carrillo, Kelley, and Kerns) failed to properly interpret and enforce our County General Plan. These three chose instead to find loopholes like the fairytale of "river dependency" to allow the rezoning of Dutra's parcels to Light industrial. Two Supervisors, Shirlee Zane and Valerie Brown spoke eloquently in favor of protecting public health from the impacts of asphalt manufacture deadly by products like heavy metals and diesel exhaust. Considering the proximity of the proposed factory to public open space used for recreation, 26 schools, and hundreds of new subdivision homes, we applauded Supervisors Zane's and Brown's NO votes on Dutra.<br />
<br />
We will continue to stand up and fight to protect Shollenberger Park, despite court decisions based on the defendants' (The County of Sonoma) briefs relying on the parsing of words and legal loopholes, and not on the real interests of the people who elected them.We will fight on to SAVE SHOLLENBERGER.<br />

The City of Petaluma and our Community have fought long and hard to preserve and protect our most popular park, our wetlands, our health, and our Gateway. These are keys to Petaluma’s future prosperity and enjoyment of this place. We will continue to make our case for the rejection of the Dutra Asphalt factory at the proposed location and defend our community against degradation by Dutra’s project.<br />
<br />
California law provides a legal path for rehearing of issues at the Court of Appeal by appellants who strongly believe the panel of judges significantly erred in their ruling.<br />
<br />
The plaintiffs are requesting that the Court of Appeal reconsider and correct their decisions on three issues:<br />
<br />
1. <b>The Court ruled that there is no remedy available for the County’s violation of the Brown Act, when the Board of Supervisors prohibited public testimony at the Dec. 14, 2010 final hearing during which the County approved the Dutra project, despite releasing hundreds of pages of new project information that very morning. </b><br />
<br />
The Brown Act protects the core democratic principle that the public should be allowed to confront and petition their elected officials through public comment at public hearings. By claiming that there is no specific penalty for violating a specific provision of the Brown Act (Sec. 54954.3), the court has left the public with “a right without a remedy.”<br />
<br />
We are asking the Court to deem the Board’s project approval actions to be null and void, to require a rehearing and revote, or provide other appropriate relief for the violations.<br />
<br />
2. <b>The Court allowed the County’s use of harmful air pollutant levels from Dutra’s prior plant operations to reduce the calculated total emissions for the new vacant project site more than ½ mile away, as if those emissions were already present on the new, vacant site.</b><br />
<br />
There are zero pollution emissions at the proposed new location. The distorted calculations made the emissions and health impacts at Dutra’s new asphalt factory appear significantly less harmful to people, wildlife and our environment.<br />
<br />
Despite our having submitted expert testimony describing these erroneous calculations during the County’s hearings, the Court overlooked that written testimony, claiming that we hadn’t submitted any comments on this point, and that we had not ‘exhausted’ the issue administratively.<br />
<br />
We are asking the Court to correct their error, to reverse its decision, and allow full rehearing on these issues, which were not properly decided.<br />
<br />
3. <b>The Court ruled that the impacts of the asphalt factory’s polluted air emissions on workers' health were adequately addressed by the County by merely citing OSHA regulations without any further analysis.</b><br />
<br />
We presented testimony about the adverse and serious consequences to workers of exposures to hot asphalt’s “blue smoke” and particulates, including cancers, pulmonary and circulatory damages. The County instead claimed that simple compliance with OSHA standards would adequately mitigate impacts, and failed to calculate, analyze or address hazardous impacts to workers as required under law.<br />
<br />
The Court further accepted the argument put forward by the County that worker health was not part of the “environment” under the California Environmental Quality Act (CEQA). Yet CEQA states that a project has significant impacts if it “will cause substantial adverse effects on human beings, either directly or indirectly.” <br />
<br />
As a result, this issue was never briefed nor heard on its merits. We are asking the Court to allow a full rehearing on these issues.<br />
<br />
<br />
<br />
There are no benefits for the City of Petaluma to have Dutra located on the Petaluma River opposite Shollenberger Park. This highly polluting industrial factory would be at our gateway for 30-40 years. <br />
<br />
<ul>
<li>We’d get wear and tear on our roads from 200,000+ diesel truck trips per year creating traffic delays at our southern entrance roads, with no assurances of cheaper asphalt – or the budget – to repair roads. Petaluma would get no sales tax.</li>
<li>There’d be only 7-10 jobs in this automated plant, and Dutra really wants to take business away from Sonoma County’s existing BoDean and Syar operators.</li>
<li>Since Dutra cannot use Shamrock’s river docks, their project would be served entirely by truck, and will not contribute to the Petaluma River’s commercial tonnage or likelihood of dredging.</li>
<li>The asphalt plant would continue to threaten the value, investment, health and popularity of Shollenberger Park, our nearby commercial businesses and residents, and the use of the Petaluma River for recreation.</li>

The First District California Court of appeals will hear oral arguments for clarification of specific points raised in the case and the appeal. The panel of judges has up to 90 days to issue its written decision (mid April, 2014). The decision requires only a majority.<br />

This is a case challenging the project under the California Environmental Quality Act law (CEQA). We are challenging Sonoma County’s failure to comply with CEQA in its approval of Dutra’s asphalt factory project (Dec. 2010).<br />

County of Sonoma, The Dutra Group, et al.<br /><br />The final Appellants' Reply Brief has been filed in 1st District Court of Appeals on Tuesday afternoon, Sept. 25, 2012<br /><br />This is the last filing of briefs in the appeal of Sonoma County Superior Court Judge Chouteau's decision in the suit against the County's approvals of the Dutra Asphalt Plant adjacent to Shollenberger Park just south of Petaluma. The plaintiffs have filed the Appeals Brief and the County and Dutra filed Opposition Briefs.<br /><br />The date for the trial at the Court of Appeals is still somewhat in the future: the Court of Appeals may take several months before actually setting the trial date, and the trial date could be as much as a year from now.<br /><br />The Plaintiffs believe that we have a very strong case on appeal, focusing on several of the trial issues and rulings.<br /><br />1. The Dutra properties are in the flood plain, and were improperly rezoned from commercial to industrial use. This is a direct violation of requirements of the Sonoma County General Plan.<br /><br />2. The Dutra asphalt plant Project is not river dependent, yet were approved despite this basic inconsistency with clear requirements of the County's General Plan. <br /><br />The Project depends on receiving shipments of aggregate and sand from the adjacent Shamrock operations, initially by truck for up to 3 years, then delivered by a conveyor belt. <br /><br />Yet Shamrock has continually insisted that they have no interest and no agreement to provide aggregate or sand to Dutra. The County cannot compel Shamrock to do so. The Dutra Project has no feasible river barge access themselves (due to navigational hazards and existing high pressure gas pipelines), so deliveries would only be by truck.<br /><br />3. The air pollution emitted from the Dutra Project were inaccurately calculated by the County and Dutra, by using the wrong baseline for emissions. <br /><br />The pollutants discharged from the closed temporary Dutra asphalt plant almost a mile away were wrongly credited against the new plant's pollutants. This artificial 'baseline' makes it seem as if the new levels of pollution and their impacts would be lower.<br /><br />4. The Final EIR did not accurately describe the final revised and County-approved Project, nor properly analyze and address its impacts, particularly the use of the Shamrock property and its aggregate supply methods, traffic, air quality, worker health, and wetlands impacts. The County refused to circulate a Revised EIR. The public was deprived of its right to examine and provide comments to the Board of Supervisors before they made any decisions on approvals.<br /><br />5. The County violated the Brown Act by refusing to allow the public to speak about the revised Project at the final hearing of the Board of Supervisors. Despite the last minute release of a series of new Project changes, reports and a new Final EIR, the public was silenced.<br /><br /><br />We are optimistic about the judicial review that will come from the Court of Appeals. We look forward to the trial. We are determined to safeguard the health of our residents, businesses, visitors and wildlife. Many people and businesses have come to enjoy and benefit from Shollenberger Park and the increased use of the Petaluma River. <br /><br />The Dutra Asphalt plant should never have been proposed for the Gateway to Petaluma and Sonoma County. We are grateful to the overwhelming support from our community in this challenge. We appreciate the City's participation in the original lawsuit and this appeal. <br /><br />One final note: While most all Petaluma City Council members have strongly supported going forth with the appeal, we are aware that some people have wavered, citing the city's costs. Most recently, City Council candidate Kathy Miller told SCCA in interview that she would not support continued city participation in the lawsuit and appeal. This position is unmerited, as it fails to recognize the generous donation of $5000 from Moms for Clean Air to the City towards the costs of the appeal, and the pledge of another $5000 from Friends of Shollenberger. If the City were to adopt that position and leave the appeal, there would be no chance for the City to recover its legal costs when we win. <br /><br />We are proud of our community, both in and beyond Petaluma, for its strong and continued support. We have borne the lion's share of the costs of the case, and are looking forward to our victory.</span></span><br />

Over 350 people turned out to support Friends of Shollenberger at the Second annual Shindig last Tuesday evening.<br />
<br />
The goal to raise funds to pay the legal costs to appeal the Dutra asphalt factory approval exceeded expectations!<br />
<br />
Many thanks to everyone who bought tickets, especially Duck Brigade Boosters, partied for the park, donated and to make this a wonderful evening of community networking and fun.<br />
<br />
Katie Freeman of The Incubators set the tone for a great party, playing on the stage in the Food Court. Thanks to Katie and her band, the atmosphere there was like a festival. Seated at the long tables, people gathered and ate the delicious food served up by five food carts: MugShot, Pizzeria Rosso, Awful Falafel, Yum Yum Trolley, and Taqueria Santa Cruz. Thanks to these wonderful purveyors of delicious food for serving our community!<br />
<br />
On the Main Stage in the Beer Sanctuary, Gabby La La and The Ukulady opened the show with their Kit ’n' Tenders ukulele duo, while kids hula hooped or listened in fascination to the music. The inimitable Peter Welker Sextet performed next, filling the space with world class jazz. Singer, Deborah Winters’ performance was mesmerizing. Closing the show as night fell, was the beautiful f Elaine Lucia, singing her original songs with her new band, The Elaine Lucia Group. MC Jason Davies thanked Elaine for her wonderful performance – what a treat to hear Elaine sing in person.<br />
<br />
In between the music , Jason Davies introduced several speakers. Each spoke about protecting Shollenberger Park form the Dutra Asphalt factory. We heard from former Mayor Pam Torliatt; Mayor Dave Glass, representing the city of Petaluma; and Kristine Weeks, representing Camelbak.<br />
<br />
Present in support of Friends of Shollenberger were Council members Teresa Barrett, Tiffany Rene, former mayor of Rohnert Park, Tim Smith, and Congressional candidate Norman Solomon.<br />

Today, Judge Chouteau denied most of Dutra's requests for reimbursement of<br />
costs related to our case against the approvals of the Dutra Asphalt Plant<br />
in Petaluma.<br />
<br />
Dutra's attorneys, Les Perry and Derek Cole, along with Aimi Dutra and<br />
political consultant Rob Muelrath, appeared in Judge Chouteau's courtoom<br />
in Santa Rosa this morning to argue their claims for over $9900 in<br />
allegedly reimbursable costs related to the trial and the preparation of<br />
the case record.<br />
<br />
The plaintiffs, including all of the community plaintiff groups and<br />
individuals, and the City of Petaluma, were represented by Christina Caro,<br />
of Lozeau/Drury LLP.<br />
<br />
After vigorous arguments about what is, and what is not legally eligible<br />
for reimbursement, Judge Chouteau decided that only $1649.46 of Dutra's<br />
asserted costs were in fact legitimate under California law. The balance<br />
of claims were denied. Judge Chouteau stated that Dutra was not entitled<br />
to receive reimbursement for costs related to Dutra's attorneys' voluntary<br />
review of the case record, which, at over 31,000 pages, was prepared at<br />
the total effort and expense of the plaintiffs. He indicated that such<br />
review was the responsibility of County Counsel, which could not, and did<br />
not, delegate that review to Dutra.<br />
<br />
County Counsel declined to file any motion for reimbursement of costs,<br />
indicating that they did not have sufficient records to be able to<br />
accurately assign any costs in the case.<br />
<br />
We are pleased that Judge Chouteau saw through the improper and<br />
unwarranted attempts by Dutra and their attorneys to try to get<br />
reimbursements for their purported expenses. Our efforts to continue to<br />
protect and defend the integrity of Petaluma's health, economy and<br />
environment will continue to victory at the Court of Appeals over this<br />
poorly planned and located project.<br />
